Minister Jeff Radebe will on Thursday appear in the Equality Court accused of racial discrimination.
This is after he refused to promote magistrate Martin Kroukamp to senior magistrate at Alberton Magistrate's Court in 2011 when he was Minister of Justice and Correctional Services.
Kroukamp is represented by Solidarity who argues that Kroukamp was overlooked for the promotion because of his race.

Head of Legal at Solidarity Anton van der Bijl says his organisation is not anti-transformation and their campaign is against unfair discrimination.
...if there is transformation, they must be fair to all the parties involved. There must be certain procedures that must be taken; you must take a more nuanced approach to transformation in a sense that you must have a realistic view of socio-economic needs. And not only promulgate a quota system based on a percentage representative demographics of South Africa.

Van der Bijl adds that Kroukamp was the best candidate for that specific position since has he has been acting in that position for a long time and he is qualified for the job.
