How easy would it be for Mampintsha to succeed with a counter charge?

It's reported Mandla 'Mampintsha' Maphumulo is pursuing a counter-charge of assault against his girlfriend, gqom artist Bongekile 'Babes Wodumu' Semilane.

Maphumulo himself was arrested this week after a video circulated on social media showing him repeatedly slapping the singer.

Joanne Joseph spoke to Managing partner at HJW Attorneys Megan Harrington-Johnson to discuss how likely Maphumulo's case is to succeed in court.

For him to succeed with a counter claim of assault against Babes, he is going to have to meet the same evidentiery burden that she would have to meet. She obviously has video evidence in her favour, he does not.

We see this a lot in domestic violence cases... often times there are counterclaims that are filed in these type of matters.

If his claim is found to be false, Harrington-Johnson says Semilane could have a civil claim against him for malicious prosecution.

There is even a criminal charge that could be laid in respect of defeating or obstructing the course of justice if it is proven by the police and NPA that he laid these charges, if he indeed did so, with the intention of obstructing the allegations into his alleged assault of her.
