What legal redress might you have for losses suffered due to loadshedding?

Legal firm De Beer Attorneys wants all South Africans who’ve experienced financial losses as a result of load shedding to contact them as part of a possible class action against Eskom.

The firm says the electricity prices that people are currently facing can be attributed to the parastatal and the mismanagement thereof.

Managing Director at De Beer Attorneys Elaine Bergenthuin explains what amount of loss could warrant a case being heard.

You really are looking at more substantial losses, maybe R 100 000 plus. Entities may find that is a worthwhile endevour to try and pursue. Public interest organisation, lobby groups etc, can always assist the households and the man on the street to pursue this action with us.

Effectively businesses, organisations and households have suffered damages as a result of load shedding and power outages, the negligence can be attributed to Eskom.

Ultimately the electricity crisis is something we can attribute to Eskom - mismanagement of funds, not channeling funds to the actual development of infrastructure, the maintenance of existing generators etc. In that sense the electrcity crisis that load shedding is trying to prevent is actually Eskom's doing and they should be held liable.
