Fench arms company Thale says former National Prosecuting Authority (NPA) head Shawn Abrahams abused his powers in pursuing charges against it and former president Jacob Zuma.
Thales is seeking a permanent stay of prosecution in the Pietermaritzburg High Court.
The company is accused of bribing the former president for protection from an investigation into the controversial arms deal.
Eyewitness News reporter Clement Manyathela is following the case.
They're saying the NPA is powerful and it was used nefariously by Shaun Abrahams. The argument is that Abrahams never gave Thales an opportunity to make representations in 2017 like they did with former president Jacob Zuma when he made his decision to reinstate charges against the company.— Clement Manyathela, Reporter - EWN
The argument that they made is that when the DA challenged the decision to drop the charges, they did so challenging the decision to drop the charges against Zuma, not the company.— Clement Manyathela, Reporter - EWN
They are arguing the decision to prosecute Thales then, together with Zuma, was irrational.— Clement Manyathela, Reporter - EWN
