Public Protector Busisiwe Mkhwebane took to YouTube on Monday to announce that she will be serving Public Enterprises Minister Pravin Gordhan with a Section 7(9) notice in terms of the Public Protector Act.
In relation to the Act, Mkhwebane has afforded Minister Gordhan an opportunity to respond, regarding her investigation into his meetings with the Gupta family and his involvement in the so-called South African Revenue Service (Sars) rogue unit.
Also, Mkhwebane found Gordhan guilty of "improper conduct" over his approval of former deputy Sars Commissioner Ivan Pillay's early retirement and payout.
Gordhan has been given 10 days to respond.
Minister Gordhan's legal representative Tebogo Malatjie confirmed that the subpoena was received via YouTube first and later an official letter came.
The minister is a public representative and will comply with his duties such, as this is a constitutional institution and he needs to respond to the notice.— Tebogo Malatji, Lawyer - Gildenhuys Malatji
The effect of the notice is that I might have found that you have done something wrong so tell me whether I have got it wrong or not.— Tebogo Malatji, Lawyer - Gildenhuys Malatji
Malatjie says the notice will be adhered to until a report is issued after which further steps will be taken if necessary.
