'The law allows police to use force to get blood samples'

A video showing a woman being restrained by the Johannesburg Metro Police Department (JMPD) to get a blood sample from her after she failed a breathalyser test has raised a lot of questions.

City of Joburg public safety MMC Michael Sun tells Joanne Joseph on the Afternoon Drive Show that the department only got hold of video on Monday and initiated an investigation immediately.

We were made aware of the video yesterday afternoon and immediately initiated an internal JPMD investigation.

We will not tolerate any illegalities, excessive force or brutality by the metro police.

He explains what will happen should you find yourself being stopped by the police in a roadblock and fail a breathalyser.

If the results do come out positive, the driver can be taken through for further processing such as withdrawing of a blood sample at a police station or a clinic or facilities.

If the driver refuses very violently, he can be detained by the police to be taken to a police station for blood samples.

There are provisions in the law that says police can put as much force as necessary so they can do their work. What is important is how much is too much force.
