Gordhan has no option but to interdict Mkhwebane's report - lawyer

Public Enterprises Minister Pravin Gordhan has filed court papers in an urgent bid to interdict remedial actions in a report released by Public Protector Busisiwe Mkhwebane last Friday.

Mkhwebane's made damning findings against Gordhan in a second report released by her office into the so-called South African Revenue Services (Sars) rogue unit.

To discuss this interdict, Bongani Bingwa talks to Gordhan's lawyer Tebogo Malatji.

In the first report, there were no timelines imposed on the remedial action to be implemented by the president. It was rather that the president must submit an implementation plan within 30 days on how he intends to implement remedial action.

Malatjie says in the recent report, Mkhwebane has directed various state institutions to take action within a specified time period.

The first one being the Speaker of Parliament must call Gordhan to the ethics committee. The second one is the president within 30 days must implement disciplinary action. And so the list goes on. In this particular case, we have no option but to interdict.
