Accountability Now has laid criminal charges against Public Protector Busisiwe Mkhwebane.
The charges of perjury and defeating the ends of justice arise out of the findings made against the public protector in a Constitutional Court judgement upholding the Pretoria High Court’s order that Mkhwebane personally pay for 15% of the South African Reserve Bank’s (Sarb) legal fees in the Absa/Bankorp lifeboat matter.
The apex court upheld the High Court's finding that Mkhwebane had acted in bad faith, it also held that the investigation was flawed and that she had put forward a number of falsehoods.
Accountability Now director Paul Hoffman explains the charges.
We have in fact laid charges, they are charges of perjury and defeating the ends of justice.— Paul Hoffman, Director - Accountability Now
The organisation has also lodged a complaint with the Legal Practice Council.
All advocates are obliged by their oath of office to uphold the rule of law and certainly you cannot uphold the rule of law and commit perjury and defeat the ends of justice at the same time. In my submission, the only appropriate medicine for a perjurer is striking of the roll of advocates.— Paul Hoffman, Director - Accountability Now
