'Brian Molefe must pay back Eskom pension payout and Solidarity legal costs'

Solidarity legal department head Anton van der Bijl unpacks the organisation's ConCourt win against the former power utility CEO.

Solidarity on Wednesday announced that the Constitutional Court has rejected former Eskom CEO Brian Molefe's leave to appeal.

Molefe was also ordered to pay almost all of Solidarity's costs.

The former CEO had announced in June that he was heading to the highest court in a bid to keep the R30m that he received as a result of an irregular pension benefit.

The High Court, in turn, had ruled on the matter compelling Molefe to pay back the money.

To discuss the ConCourt's ruling, Clement Manyathela on the Xolani Gwala Show chats to Solidarity legal department head Anton van der Bijl.

This is excellent news, Mr Molefe must pay back the money that was paid to him by the Eskom pension fund. The ConCourt ruled that that payment was unlawful and there was no possibility of him succeeding at the appeal. So he must pay back the Eskom payout and our legal costs as well.
