The journey of counterfeit goods once they have been seized

Over 14000 pairs of suspected counterfeit sports shoes were seized by SARS customs officials at the Lebombo Border post.

The brands sported by the shoes were Converse Chuck Taylor All Stars, Adidas, Nike and Puma.

Vanessa Ferguson, Director at DM Kisch and head of their anti-counterfeiting department spoke to us about the legal process involved in such cases and the fate of many fake products that are seized.

This was a detention made by customs. They would have to determine if the goods are counterfeit or original products...Once the goods are seized they are placed in a warehouse pending court proceedings.

Ferguson says there is a long line of procedure to be followed before determining what can be done with such goods.

She advises that the brand holders are responsible for ensuring that the goods do not reach the market.

She says that the goods can only be released once a court order has been given or a settlement is reached for the goods to be destroyed by the brand holders.
