Pretoria chief magistrate Desmond Nair has been provisionally suspended pending the finalisation of an inquiry into his fitness to hold office.
Nair was charged with two counts of misconduct in November last year following a preliminary investigation by the ministry.
The misconduct charges relate to allegations that Nair allegedly asked for or accepted/received special favours or benefits from Bosasa.
Joanne Joseph spoke to the Magistrates Commission's spokesperson Cassim Moosa to find out more.
The investigators interviewed various witnesses in respect to the allegations that were made at the state capture commission and once all the evidence and affidavits were received, the investigators had recommended, based on the evidence, that the magistrate be charged with two counts of misconduct.— Cassim Moosa, Magistrates Commission - Spokesperson
The chief magistrate is now provisionally suspended. What will then happen is that an independent tribunal will then lead the evidence and that particular tribunal will make a determination regarding the fitness of the magistrate to hold office.— Cassim Moosa, Magistrates Commission - Spokesperson
