The law catches up with 21st Century: Cybercrime Bill

The Department of Justice & Constitutional Development is taking steps to consolidate and strengthen SA’s legislative framework governing cybercrime and cybersecurity.

The Cybercrimes and Cybersecurity Bill targets a range of crimes including illegal interception, phishing, dumpster diving, theft and online buying of personal information, hacking, and the use of malware like viruses, worms, logic bombs or trojan horses.

Forensics co-head and Director at ENS Africa, Dave Loxton unpacked the bill saying that it's purpose is to update South Africa's law to allow prosecutors, and the law, to be able to deal with cases of online theft in South Africa.

The bill is aimed at stopping people accessing files and intercepting information unlawfully ... Going back to basics the intention of this piece of legislation is to stop the intention of criminal conduct

It can be very difficult for a prosecutor to prosecute a case of theft where the internet was used ... the underlying purpose of the act is to consolidate the various pieces of legislation and bring our common law crimes within the ambit of the modern era to enable authorities to then stamp out the hacking and the traditional cyber crimes that you and I are aware of.
