State likely to win Oscar Pistorius conviction appeal, says expert

The Supreme Court of Appeal is considering the State's application to to have Oscar Pistorius' culpable homicide conviction overturned to murder.

The SCA heard arguments from both the State and the Defence in the State's application on Tuesday.

Criminal law attorney Tyrone Maseko says State prosecutor Gerrie Nel presented his arguments well and stood a chance at having the conviction overturned.

Maseko believes that the appeal will be accepted and remitted to the High Court for re-sentencing.

The Prosecution argued that the judge made legal errors in convicting Pistorius of culpable homicide and excluded key elements when making her decision.

Defence advocate Barry Roux struggled a bit and i'm not surprised. It's not a slam dunk yet, but I think Gerrie Nel will fairly comfortable that he has made is case.

Maseko said the alleged admission of defeat by Pistorius' defence advocate Barry Roux after court pproceedings will not have any bearing on the SCA outcomes.
