'Zuma's lawyers say it's not that he doesn't want to testify, he just can't'

Business Day senior specialist reporter Karyn Maughan gives an update of what transpired at the state capture inquiry.

After former president Jacob Zuma's legal team argued that he will be undergoing intense medical treatment overseas and won’t be available before March, Zuma will not be issued with a summons to appear before the state capture inquiry just yet.

Zuma was due to testify before the commission from January 27 to 31.

Chaired by Deputy Chief Justice Raymond Zondo, the inquiry resumed its work on Tuesday.

Bongani Bingwa chats to Business Day senior specialist reporter Karyn Maughan to weigh on Zuma's alleged illness.

Maughan says Zuma's lawyer told Zondo that he can be taken to meet with Zuma medical doctor and Zondo can then understand what is wrong with the former president.

At this point because of the provision of privacy that exists around people's health, we actually don't know what medical condition Zuma suffers from. The move by the legal team to say Zondo can meet with Zuma's doctor is quite extraordinary. Zuma's lawyers are saying it's not that he doesn't want to testify, he is just unable to do so.

She says even though the inquiry's legal team will not persist in seeking summons for the dates dictated by Zondo, it will seek the issue of summons for a later date that is appropriate.

It was then lieutenant-colonel Christine Anderson's turn to take the stand and she told the commission that it was unusual that she was told by Bruce Koloane, then in charge of protocol, that Zuma was aware of the flight landing at the Waterkloof Air Force Base because this had never happened before.
